Client Agreement – Individual, Corporate & Group Bookings
Purely Polished Pty Ltd ACN 94 620 008 175 (we, our, us, or Purely Polished) operates a beauty and wellness marketplace, connecting Beauty and Wellness Professionals with clients to provide on-demand, mobile beauty and wellness services.
This agreement applies to all bookings, including:
- Individual (at-home) bookings for private clients.
- Corporate & group bookings for events, workplace wellness, or whitelabeling.
All defined terms in this agreement have the meaning specified in the Definitions section.
By confirming your booking, you agree to these Terms.
1. Purely Polished Services
a. For all bookings, Purely Polished acts as your booking agent, connecting you with Beauty and Wellness Professionals to provide mobile beauty and wellness services.
b. Upon receiving a Service Request, Purely Polished will provide you with a Proposal (for corporate/group bookings) or a Booking Confirmation (for individual clients).
c. Any Proposal issued by Purely Polished is valid for 30 days from the date of issue.
d. You must review the details of your Proposal/Booking Confirmation carefully to ensure accuracy. Any costs incurred due to incorrect or inadequate information provided by you may result in an Additional Charge.
e. Service Pricing & Duration:
- Individual (At-Home) Bookings: Services are priced per session.
- Corporate & Group Bookings: Minimum 2 hours per booking, charged per hour, with 15-25 minutes per person. Can be performed by one or multiple stylists.
f. On-Site Service: Services are provided at your location (home, workplace, event venue, etc.).
2. Payments
a. Individual Clients: Payment is required at the time of booking.
b. Corporate & Group Bookings:
- If the Event Date is more than 14 days away: Full payment must be made at least 7 days prior to the event.
- If the Event Date is less than 14 days away: Full payment is required immediately to confirm the booking.
c. Payment Methods:
- Credit Card Payments: Incur a 1.75% processing fee for Visa, Mastercard, and Amex.
- Bank Transfers: No processing fees apply.
3. Cancellations & Rescheduling
3.1 Individual Clients (At-Home Bookings)
a. Cancellations must be made at least 48 hours in advance to receive a full refund.
b. If canceled within 48 hours, the full service fee will be charged.
3.2 Corporate & Group Bookings
c. For bookings of 5 hours or less: 72 hours' notice is required for cancellations or changes.
d. For bookings over 5 hours: 3 weeks' notice is required.
e. For corporate events booked more than one month in advance: Full payment is required at the time of booking. If canceled, the full amount remains payable unless we can fill the slot with another booking.
3.3 Late Cancellations & Changes
f. If a cancellation occurs outside the notice periods in clauses 3(a)-(e), Purely Polished reserves the right to charge the full amount specified in the invoice.
g. If sufficient notice is provided, refunds will be processed within 5 business days.
h. Changes to bookings (date, time, duration) outside the notice period will be reviewed on a case-by-case basis, and additional charges may apply.
4. Client Responsibilities
a. Purely Polished connects you with independent Beauty and Wellness Professionals. Services are provided by independent contractors, not by Purely Polished itself.
b. As the recipient of services, you agree to:
i. Comply with reasonable requests from the Beauty and Wellness Professional.
ii. Provide a safe, clean, and suitable space for services.
iii. Ensure the location has access to a bathroom, electrical outlet, and sink (if required).
iv. Ensure that all guests behave respectfully towards the Beauty and Wellness Professional.
c. Zero-Tolerance Policy:
- Purely Polished and its service providers have a zero-tolerance policy for inappropriate, discriminatory, or suggestive behavior.
- If a client or guest acts inappropriately, the Beauty and Wellness Professional or Purely Polished reserves the right to terminate the booking immediately with no refund.
5. Parking & Access
a. You are responsible for providing or covering the cost of parking if no free parking is available.
b. If the service location is in a restricted-access area (e.g., apartments, office buildings), you must arrange easy access for the service provider.
6. Uniform Policy
a. Beauty and Wellness Professionals will wear neutral clothing plus a branded apron or T-shirt, unless otherwise specified.
7. Limitation of Liability
a. Purely Polished will use its best efforts to connect clients with highly qualified service providers. However, we do not guarantee specific results or outcomes.
b. To the fullest extent permitted by law, Purely Polished is not liable for any loss, damage, or expenses arising from:
- The performance or non-performance of the services.
- Delays, errors, or service dissatisfaction.
c. Our liability is limited to:
i. Re-supplying the service, or
ii. Providing a refund (at our discretion).
8. Client Content & Testimonials
a. If you post reviews, testimonials, or social media content mentioning Purely Polished, you grant us permission to share or republish this content for marketing purposes.
b. We may use your feedback on our website, social media, or other promotional materials.
9. Dispute Resolution
a. If a dispute arises, both parties agree to attempt a good-faith resolution before taking legal action.
b. Disputes must first be escalated to senior management for resolution within 14 business days.
c. Purely Polished is not obligated to intervene in disputes between clients and independent service providers but may choose to do so.
10. General Terms
a. These Terms supersede all prior agreements and apply to all bookings unless a separate written agreement is in place.
b. This agreement is governed by the laws of New South Wales, and any disputes will be handled under NSW jurisdiction.
c. If any provision is found to be unenforceable, the remaining provisions will remain in effect.
d. All notices, cancellations, and modifications must be provided in writing via email.
11. Definitions
Additional Charge: Fees for extra work, late changes, or costs due to client-provided misinformation.
Beauty Professional: Independent contractor providing the service.
Client: Any customer (individual or corporate) booking a service with Purely Polished.
Corporate & Group Bookings: Bookings for workplaces, events, or groups of 2+ people.
Event Date: The date of service.
Purely Polished Services: The marketplace function of connecting clients with independent professionals.
